Operational Terms and Conditions
  1. Acceptance:

    Seller’s acceptance of Buyer’s purchase order is expressly made conditional on buyer’s acceptance of the following terms and conditions of sale.

  2. Prevailing Goods and Services Tax (GST) or any other taxes as the appropriate government may levy from time to time shall be applicable.

  3. HSN (Harmonized System Nomenclature) Codes shall be as per the supplier / Manufacturer and BG will not be responsible for the same

  4. Cancellation Of Order By Customer:

    Cancellation or addition of any new item to the existing order shall be subject to processing. The cancellation shall be done before TWO hours from the time of placing the order.

  5. Delivery to multiple locations shall be treated as separate orders. The logistics cost should be borne by the customer.

  6. For orders more than INR 15000, Cash on Delivery is not applicable. This value shall not be applicable for items that involve carriage thro’ HTV or LMV.

  7. Transit insurance for fragile items of more than 50K value shall be applicable at buyer’s cost.

  8. No Return Policy:

    Return of the items shall not be applicable for Fragile goods, paints and lubricants, tiles & stones, custom made products and items that are specially mentioned by the supplier. Further, no goods shall be returned for credit without first obtaining written consent (ink or electronically signed) from an authorized executive of Bauenguru.

  9. Variation Clause:

    The Colour shown in the website or catalogs shall vary. Customer has to make careful choice before ordering. The size and weight at the time of delivery shall also vary subject to conditions mentioned by the supplier. Customer shall refer IS (elaborate this IS) code for any variations.

  10. Invoice shall not be processed immediately after the order is placed by the customer, only confirmation of the receipt of the order shall be issued electronically vide email. Post the material delivery, the actual invoice shall be sent to the customer.

  11. If there is a price reduction for any commodity / item / service after the order is placed, Bauenguru shall not be refunding the amount at any cost.

  12. Order Declining:

    Customer order can be declined for the following reasons irrespective of time of order placement:

    • Not paying the payment;
    • Non-availability of material at the supplier end;
    • Cheque bounce by the customer;
    • Over lead time;
    • Decline by the supplier;
    • Any other administrative reasons.
  13. Refund Policy:

    Bauenguru will not refund the amount paid by the Customer as payment at any cost unless the PO is not processed to the supplier.

  14. In case of cancellation of order by the customer, provision for adjustment of payment already made for any future orders is at the discretion of the customer.

  15. Customer has to sign-off the materials shortage at the time of unloading for delivery confirmation on the delivery receipt. Post the sign off, any shortage reporting will not be entertained.

  16. Shipment:
    • Manufacturer / Supplier should not mix the consignment and should be as per the materials ordered on PO only, if not, the wrong materials will be rejected and all such costs shall be borne by the Manufacturer / Supplier.
    • Manufacturer / Supplier should not mix materials other than material ordered by Bauneguru. If found, the material shall be rejected and payment will be reversed / claimed.
    • Delivery terms are either F.O.B. Seller's place of manufacturing or C.F. , as specified on the reverse side of this document. In either case, Buyer shall assume all risk of loss or damage upon delivery by Seller to the carrier at the point of shipment. Scheduled dates of delivery are determined from the date of Seller’s acceptance of any order or orders placed by Buyer and are estimates of approximate dates of delivery, not a guaranty of a particular date of delivery. Seller shall not be liable for any damages caused by failure or delay in shipping the goods described herein, if such failure or delay is due to any war, embargo, riot, fire, flood, accident, mill condition, strike or other labor difficulty, an act of Buyer, an act of God, an act of a governmental authority, transportation shortage or failure, inability to obtain sufficient fuel, labor, materials or manufacturing facilities, or any other cause beyond the reasonable control of Seller.
  17. Additional orders will be considered as New Orders.

  18. Excess delivered items / materials will not be the responsibility of Bauenguru. However, Bauenguru will attempt to convince / inquire into the excess materials with the customer.

  19. All quotes shall be valid only for 3 days from the date of it is making to customer.

  20. All cheques and payments made by the Customer are subject to realization and all the cheques shall be drawn in favour of “Bauenguru Online India Pvt. Ltd, Bangalore”.

  21. The cancellation amount shall be credited only to account from which the order was placed within 07 working days from the date of its cancellation. Under no circumstances, the amount shall be transferred to any new account.

  22. In case of part payment, delay to receive the delivery of consignment or request for deferring the delivery of consignment date from the Buyer will not excuse the Buyer from making the payment for the orders placed as per the initial agreed terms.

  23. Indemnification:

    Buyer agrees to save and hold Seller harmless from any claims, demands, liabilities, costs, expenses or judgments arising in whole or in part, directly or indirectly, out of the negligence or lack of care by Buyer or Buyer’s customers, agents, employees or invitees involving the use of the goods supplied by Seller. This indemnification shall include all costs, attorney’s fees and other expenses paid or incurred by or imposed upon Seller in connection with the defense of any such claim.

  24. Disputes:

    Any disputes / differences / claims arising out of this transaction shall be subject to the jurisdiction of the Courts in Bengaluru, Karnataka.
